This Privacy Policy has been drawn up by SafeDrivePod International B.V., a Dutch private company specialized in traffic applications development, and applies to this company and her subsidiaries and affiliates. These are further referred to as 'SafeDrivePod'.

SafeDrivePod International BV takes your privacy very seriously. That is why we have this Privacy Policy, which discloses the information gathering and dissemination practices through the SafeDrivePod software applications such as the SafeDrivePod Apps and websites. When starting to use the SafeDrivePod software applications, this Privacy Policy is presented and you are asked for consent. This document explains why we collect certain personal information and how we protect the information that you provide to us. We also inform you about your rights and the conditions under which we provide information to you and to others.

The General Data Protection Regulation (GDPR) is in effect as of May 25, 2018. As a result, from that date, the same privacy legislation applies throughout the European Union (EU). SafeDrivePod's Privacy Policy has been drawn up in accordance with this legislation.

If you have any questions regarding this Privacy Policy, please send an e-mail to our Customer Service team on support@safedrivepod.com. Preferably state the word 'Privacy' in the header.

What is "personal information"?

"Personal information" means information that identifies you or could reasonably be used to identify you or another person and which is submitted to and/or collected by the app and maintained by SafeDrivePod International BV in an accessible form. Examples of personal information include your name and your e-mail address.

SafeDrivePod product(s) and software: what information do we collect and how is the information used?

To make use of our services and products, it is necessary that you provide a limited amount of personal information. Our services and products include the SafeDrivePod apps for iOS and Android, for smartphone distraction, driving behaviour and crash response in combination with the SafeDrivePod hardware, the SafeDrivePod website, the SafeDrivePod dashboard that provides (fleet)managers an overview of all relevant data, the Corona-tracer app, and more. The personal information that you provide to us by using the app or site is used by us in the first place to make the SafeDrivePod applications work. Further, it is used to be able to send you information upon request, maintaining contacts with you, and conduct market research and automatic statistical analysis of profiles of our customers.

We use your data mainly and above all to ensure that the SafeDrivePod applications are functional and ensure extra safety while driving. For example, we need your phone number to identify the smartphone connected to the SafeDrivePod, so that we know you are driving your car and not sitting in the train. We need your e-mail address to send you messages in case you have accidentally turned off the app or Bluetooth.

SafeDrivePod app

In general, for our app to work properly, we need your phone number to identify the smartphone connected to the SafeDrivePod, so that we know you are driving your car and not travelling by train. We need your e-mail address to send you messages in case you have accidentally turned off the app or Bluetooth, and we ask your name to properly address you in our communication. We further collect data about the following, each including a timestamp:

  • Whether you have installed the app
  • Whether you have connected to the SafeDrivePod hardware (the ‘pod’), including its serial number
  • Whether you have Bluetooth switched on/off
  • Whether you have GPS turned on/off (if you chose to use GPS to determine whether you are driving or not; default the pod determines whether you are driving based on accelerometer measurements and GPS is not used, but the user can opt for the smartphone GPS to determine whether you are driving if e.g. engine vibrations make the accelerometer measurements not accurate enough.)
  • Driving time
  • Distance travelled (based on driving time with pre-set average speed, or based on actual GPS data, depending on user preference, see above)
  • Number and length of telephone calls while driving, unless otherwise agreed with the customer
  • Type and version of OS (Android or iOS) of telephone used, and version of our app that is installed

Specifically for the SafeDriveFocus functionality in the app (preventing driving distraction) and specifically for iPhone users, we count the number of times you tried to unlock the phone while driving.

Specifically for the SafeDriveMotion functionality in the app (driving behaviour) we collect the following data:

  • The number of harsh and medium brake events per trip
  • The number of harsh and medium acceleration events per trip
  • The number of harsh and medium cornering events per trip

Specifically for the SafeDriveResponse functionality in the app (crash detection) we collect the following data:

  • The G-force of a crash event if the impact is above a certain minimum G-force
  • Position of impact (left/right/front/rear)
  • The date and time of the event
  • The location of the event based on GPS data of the phone, if this is permitted by you (this is the only time we use your location information in order to be able to help you in a moment of stress)

We do not keep track of how fast you drive or where you drive: so we do not use or store your phone's location data, because we do not believe it is necessary for understanding your driving behaviour and it would be too much of an invasion of your privacy.

In some cases the SafeDrivePod app contains a so-called SOS button or ‘Blue button’. We register when these buttons are used. The SOS button will activate the phone to call the emergency telephone number and the Blue button will give you full control of the phone again. Dependent on the agreement with the customer, the number of Blue button uses is limited.

SafeDrivePod dashboard

Fleet managers or similar officials that manage a group of cars or drivers can have access to our dashboard. The level of access to the collected data is dependent on the permissions that are discussed with the customer and agreed upon in a separate Data Processing Agreement. Of this administrator we need the following information: personal name, e-mail address and the name of the company where they are employed.

SafeDrivePod website

If you are not a customer or user of our system, you still can visit our website. You can fill out an online form to request information from us. For that we ask you the following data: your name and e-mail address, so that we can contact you.

Cookies

The SafeDrivePod apps and websites only use transient cookies or so-called session cookies to establish a connection. Session cookies are temporary bits of information that are erased once you turn your device off.

The SafeDrivePod sites ask you for permission to use Analytics cookies. We have signed a data processing agreement with Google, which further precludes sharing of Google Analytics data by Google with third parties. By masking the last octet of your IP address, we further increase your anonymity.

Our use of cookies is safe. Personal information such as a phone number or an e-mail address, cannot be traced by placing session cookies. As a result, cookies cannot be used for e-mail and telemarketing purposes. You can find more information about cookies at www.allaboutcookies.org.

Corona-Tracer product and software

A Corona-Tracer stores the device numbers (so-called MAC addresses) of other Corona-Tracers when closer than 2m, to keep track to whom someone has been in close proximity. When a person is ill, the Corona-Tracer is read out with an app, which sends the list as an Excel file to a self-selected e-mail address or own cloud drive. This data file is not sent to our server and the data is therefore not visible to us.

When using the Corona-Tracer, we do not request any personal data, except from the designated person within the company who uses the app to read a Corona-Tracer in case of illness, for which a temporary password is issued by us. We ask this person's e-mail address to provide better support.

The link between MAC addresses and personal data is the responsibility of the company that uses the Corona-Tracers.

How long do we store your data?

The collected data will be retained until the end of the contract period, unless you request to remove your data earlier.

Combination of personal information

SafeDrivePod may combine the personal information that you provide through the app with personal information provided by you through other media such as when you contact us by telephone.

SafeDrivePod may combine personal information that you provide to us online with our offline records.

SafeDrivePod may combine personal information that you have provided to us directly with records provided by third parties.

We use this consolidated information mainly and most importantly to make the SafeDrivePod application work, providing you with the extra safety while driving. We further use this consolidated information to help us improve the design of this app and other products, to enhance our marketing and research activities and to facilitate other business functions.

Transfer of personal information to different jurisdictions

SafeDrivePod stores data on secured servers in several countries around the European Economic Area or other countries which have been deemed to provide adequate protection of your personal information.

SafeDrivePod requires all entities outside the European Economic Area to which it transfers personal information to protect it in accordance with EU data protection standards.

Your rights

In accordance with GDPR law, you may at any time request access to the information we collect about you. You may also request that we amend, correct or delete your personal information or restrict processing. To do this please contact us using the contact details at the end of this document. If you request us to delete your personal information, the result may be that we can no longer provide our services to you.

To ensure that the request for inspection has been made by you, we ask you to send an e-mail using the same e-mail address as used for registration plus the last three digits of your phone number. We will respond to your request as quickly as possible, but within four weeks.

You have the right to lodge a complaint to the data protection officer (see address below) or to the management of SafeDrivePod International BV.

Business continuity

You agree that database rights subsisting in the personal information collected from you by SafeDrivePod is currently under the responsibility of SafeDrivePod International BV.

In the event that SafeDrivePod International BV becomes the object of an acquisition, merger, sale or other transaction and the database, or the company that owns the database, is acquired by a third party, you will be informed about this by e-mail. If you do not want disclosure of your personal information to its advisers and the acquiring third party, both during and after the transaction, you can respond to this e-mail. If you do not give permission, your data will not be disclosed, which could mean a discontinuation of the services after the transaction is closed. When the transaction is closed, you will be informed about the transaction and the ownership and control over the database and your personal information that you provided to SafeDrivePod. The personal information will be transferred to the third party, in accordance with the provisions and limitations of this Privacy Policy. If the transaction is not closed, SafeDrivePod will have the third party to agree that it ceases using your personal information.

Security

Protecting your privacy is important to you and to us. That is why our systems and programs are adequately protected. We use management procedures to keep the information accurate, up-to-date and complete and to prevent access to your personal information by unauthorized persons from inside and outside our organization. This includes also - but is not limited to - encryption of connections and content.

Although SafeDrivePod secures all personal information, we urge you to exercise caution when transmitting personal information over the Internet.

Service updates and other information

If you are a SafeDrivePod customer with access to the SafeDrivePod dashboard, we may send you, with your explicit consent, information – or contact you otherwise – regarding new services, features and other announcements, in the form of a newsletter or otherwise. It is possible to unsubscribe from these communications.

Third-party data processing

In many cases you have received the SafeDrivePod products and services through a third party, like an employer, insurer, leasing company, etc. This third party has access to the data of employees/customers through a dashboard on the SafeDrivePod site. This may only be an overview of the averages and/or totals, but may also provide insight into data up to an individual level. It is therefore essential for the third party to treat the data with the same care as we do. We therefore make sure that a so-called Data Processing Agreement is signed with the third party, which describes the rights and obligations in accordance with our Privacy Policy, before the third party is provided access to the dashboard.

Nullification of terms

In the event that the terms of this Privacy Policy are declared partially invalid, parties remain bound to the remaining part. The parties shall replace the invalid parts by provisions that, given the content and purpose of these terms, are valid and have a legal effect similar or as close as possible to that of the invalid part.

Governing law and competent court

Subject to applicable local law, these terms are exclusively subject to the current Dutch law. A competent court in Amsterdam shall settle all disputes arising in connection with these terms.

Changes to Privacy Policy

SafeDrivePod International BV reserves the right to make changes and/or updates to this Privacy Policy at any time without notice, to reflect technological advancements, legal and regulatory changes and good business practices. We encourage you to save and consult this webpage for the latest version of this Privacy Policy, which can be identified by the date on the document.
